Declarations of Interests

In accordance with the Council's current Code of Conduct (adopted July 2012), which includes all the provisions relating to Disclosable Pecuniary Interests (DPI), personal and prejudicial interests , Members are asked to declare any DPI and also any personal interests (and whether or not such personal interests are also "prejudicial") in relation to any matter on the Agenda for this meeting. A DPI is defined in The Relevant Authorities (Disclosable Pecuniary Interests) Regulations 2012 (SI 2012 No. 1464) and Appendix 3 of the Council’s Code of Conduct.  A personal interest is defined in paragraph 2.8 of the Code and a prejudicial interest is defined in paragraph 2.9. In the interests of complete transparency, Members of the County Council, who are not also members of this committee, are encouraged to declare any interests they may have in any matters being discussed even though they may not be under any obligation to do so under any relevant code of conduct.

Minutes:

The Committee noted the procedure to be followed when considering Licensing Applications under the Licensing Act 2003.  The Chairman introduced the members of the Sub-Committee and the Officers present at the hearing.

 

The Chairman confirmed that the Officer’s report relating to the case, the procedure to be adopted during the hearing and the documents which the authority is required to provide under the Regulations had been received by all Parties in advance of the meeting.

Minutes:

In accordance with Section 100A(4) of the Local Government Act 1972 (as amended), the Committee resolved that the press and public be excluded from the meeting for the following item in view of the likely disclosure of exempt information as described in Paragraph 3 of Part 1 of Schedule 12A to the Act.

Representations following an Application to Transfer the Premises Licence and an Application to Vary the Designated Premises Supervisor at Maximart, 13-15 Sherborne Road, Yeovil, BA21 4HD/HH - Closed Session

Minutes:

The Specialist – Licensing presented the report.

 

The Committee was addressed by a representative from Avon & Somerset Constabulary. 

 

The Committee were then addressed by the Applicant’s representative.

 

Members were given the opportunity to ask questions.

 

The Officers and Parties with the exception of the Legal Specialist and the Case Services Officer - Support Services, attending in an advisory capacity only, withdrew from the meeting to allow members of the Sub-Committee to consider their decision in private.

 

When the meeting was reconvened, the Chairman informed those present at the hearing of the decision of the Licensing Sub-Committee.

 

RESOLVED:

That in respect of the application to Transfer of a Premises Licence & variation of the designated premises supervisor for the property at Maximart, 13-15 Sherborne Road, Yeovil, Somerset, BA21 4HD/4HH under Section 39 & 44 of the Licensing Act 2003, the Licensing Sub-Committee has determined to Transfer the Premises Licence and to GRANT to vary the Designated Premises Supervisor.
