Declarations of Interests In accordance with the Council's current Code of Conduct (adopted July 2012), which includes all the provisions relating to Disclosable Pecuniary Interests (DPI), personal and prejudicial interests , Members are asked to declare any DPI and also any personal interests (and whether or not such personal interests are also "prejudicial") in relation to any matter on the Agenda for this meeting. A DPI is defined in The Relevant Authorities (Disclosable Pecuniary Interests) Regulations 2012 (SI 2012 No. 1464) and Appendix 3 of the Council’s Code of Conduct. A personal interest is defined in paragraph 2.8 of the Code and a prejudicial interest is defined in paragraph 2.9. In the interests of complete transparency, Members of the County Council, who are not also members of this committee, are encouraged to declare any interests they may have in any matters being discussed even though they may not be under any obligation to do so under any relevant code of conduct. Minutes: The Committee noted the procedure to be followed under the Licensing Act 2003 when an objection to a Temporary Events Notice (TEN) has been received.
The Chairman introduced the members of the Sub-Committee and the Officers present at the hearing.
It was confirmed that no notices of objection had been withdrawn and that all parties had received the relevant documentation.
It was noted that the applicant was not present at the meeting.

Minutes: The Chairman asked the Specialist (Licensing) to introduce all 3 Temporary Event Notices together and confirmed that they would be individually discussed by the Committee when they withdrew from the meeting to consider their decision in private.
The Specialist (Licensing) advised that 3 Temporary Event Notices (TENs) had been submitted for one event to be held at Yeovil Showground, Two Towers Lane, Barwick, Yeovil, BA22 9TA, from 27 August to 29 August 2021. Two objection notices had been duly served by the Police Licensing Officer on behalf of the Chief of Police for Avon and Somerset Constabulary and also from the Environmental Health Specialist for the SSDC Environmental Protection Team (noise) for the 3 Temporary Event Notices.
The Specialist (Licensing) explained that the objections related to the supply of alcohol and regulated entertainment. The site had been divided into 3 ‘zones’ and the applicant had requested a maximum of 499 people in each of the zones. The area was already subject to a premises license and the police and environmental health representatives had identified a number of conditions which they would like attached to the Temporary Event Notices to address their concerns. The conditions relating to the time scales involved had been removed to allow the applicant to move forward if the 3 TENs were approved. She said the Committee may wish to add a 7 day timescale to the conditions so they could be reviewed by the objectors prior to the start of the event.
It was noted that the objections raised by the Police and Environmental Health had been given in confidence and therefore the Committee resolved to hear their discussion in private.
The Committee were addressed by the Police Licensing Officer on behalf of Avon and Somerset Constabulary and the Environmental Health – Specialist Officer.
Members of the Licensing Sub-Committee, Specialist (Legal) and Case Officer, attending in an advisory capacity only, withdrew from the meeting to allow the members of the Sub-Committee to consider their decision in private.
When the meeting reconvened, the Chairman informed those present at the hearing of the decision of the Licensing Sub-Committee.
The Licensing Sub-Committee determined that the events at Yeovil Showground, Two Towers Lane, Barwick, Yeovil, BA22 9TA on 27 August to 29 August 2021 should proceed in accordance with the temporary event notices.

Notice of Decision
In respect of the Temporary Event Notice received for Yeovil Showground, Two Towers Lane, Barwick, Yeovil, BA22 9TA, under the Licensing Act 2003, the Licensing Sub-Committee has determined that the events on 27 August to 29 August 2021 should proceed in accordance with the temporary event notices.
The Sub-Committee noted the objections raised by the Police and Environmental Health – Specialist Officer. The Sub-Committee took into account their submissions and that they were keen for the event to proceed but were concerned that conditions were needed to promote the licensing objectives and requested that relevant conditions of the premises licence were added for the event, as this would satisfy concerns of public safety and crime and disorder.
With regards to noise nuisance, the Sub-Committee noted the Environmental Health – Specialist Officer concerns that the TEN applications contained no details in respect of proposals for noise mitigation and adding that the conditions would allow noise nuisance to be properly assessed, including the likely impact of noise disturbance to residential properties which, would be affected by noise from the event particularly during unsociable hours.
The members were concerned that the applicant had failed to attend as they would have liked to have heard submissions from him but they were keen to support local events and were satisfied in adding relevant conditions to the TENs would satisfy the promotion of the licensing objectives
There had been consultation with the Police and the Environmental Health – Specialist Officer as to the measures which should be put in place for such an event and the applicant had agreed for the conditions of the premises licence to be added to the TENS.
The Sub-Committee was therefore satisfied that there were sufficient measures in place to manage an event of such a scale as long as the Event Management Plan had been agreed 7 days prior to the event.
The Sub-Committee approved the three applications for the temporary event notices.
All parties are reminded that there is a right of appeal against the decision of the Licensing Authority. Such an appeal is to be made within 21 days of the date of receipt of the formal Notice of Determination, and should be made to the South Somerset Magistrates Court.
